Aanvaardbaar gebruik (AUP)

Dit beleid voor aanvaardbaar gebruik (Acceptable Use Policy of "AUP") beschrijft wat wel en niet is toegestaan bij het gebruik van de diensten van Upstream. Het maakt integraal deel uit van en vult onze algemene voorwaarden aan. Door onze diensten te gebruiken, ga je akkoord met dit beleid.

1. Reikwijdte en op wie dit van toepassing is

Dit beleid geldt voor al onze diensten, waaronder webhosting, VPS en cloud servers, domeinregistratie, e-mail, datacenter en housing, en managed services. Het is van toepassing op elke klant en op iedereen die onze diensten gebruikt via die klant: medewerkers, subaccounts, klanten van resellers en bezoekers van gehoste websites. De klant is verantwoordelijk voor al het gebruik dat onder zijn account of dienst plaatsvindt.

2. Toegestaan gebruik

Je gebruikt onze diensten uitsluitend voor rechtmatige doeleinden, in overeenstemming met de overeenkomst, dit beleid en de toepasselijke wetgeving. Je respecteert de rechten van andere gebruikers en de goede werking en veiligheid van onze infrastructuur.

3. Verboden gebruik

Het is onder meer verboden om onze diensten te gebruiken voor:

illegale inhoud of activiteiten, waaronder materiaal met betrekking tot kindermisbruik, terrorisme, of het aanzetten tot haat, geweld of discriminatie;
het schenden van intellectuele-eigendoms- of auteursrechten, of het verspreiden van illegaal verkregen materiaal;
spam of ongevraagde massa-e-mail, phishing, oplichting, fraude, valse webshops of andere misleidende praktijken;
het verspreiden van malware, virussen, ransomware of andere schadelijke software;
hacking, ongeautoriseerde toegang, poortscans, exploits of denial-of-service-aanvallen (DoS/DDoS);
het draaien van open mail relays, open proxies, botnets of command-and-control-infrastructuur;
cryptomining zonder onze uitdrukkelijke toestemming;
overmatig verbruik van gedeelde middelen dat de dienstverlening aan andere klanten schaadt;
het omzeilen van beveiligingsmaatregelen, gebruikslimieten of toegangscontroles.

4. Risicovolle of beperkte activiteiten

Bepaalde activiteiten zijn enkel toegestaan mits je de regels naleeft, en soms na voorafgaand overleg met ons:

Massamailing, nieuwsbrieven en marketingmail: het versturen van bulk- of marketingmail via onze diensten is enkel toegestaan met onze voorafgaande schriftelijke goedkeuring. Ook met die goedkeuring gelden steeds een geldige opt-in en de anti-spamwetgeving. Zonder onze uitdrukkelijke toestemming is bulkmailing niet toegelaten;
Inhoud voor volwassenen: enkel voor zover wettelijk toegelaten en correct afgeschermd;
Zwaar of atypisch resourceverbruik: in overleg, zodat de stabiliteit voor andere klanten gewaarborgd blijft.

5. Naleving van wetgeving en sancties

Je gebruikt onze diensten in overeenstemming met alle toepasselijke Belgische en Europese wetgeving, waaronder de privacywetgeving (GDPR), de consumenten- en e-commercewetgeving, de telecomregels en het intellectuele-eigendomsrecht. Onze diensten mogen niet worden gebruikt in strijd met internationale sanctie- en exportregelgeving, noch door of ten behoeve van personen of entiteiten die op een toepasselijke sanctielijst staan.

6. Verantwoordelijkheid voor derden en subgebruikers

Je bent volledig verantwoordelijk voor het gebruik van onze diensten door je medewerkers, subaccounts, eindklanten en bezoekers van je websites of toepassingen. Resellers en klanten die onze diensten aan derden aanbieden, leggen hun eigen klanten een beleid op dat minstens gelijkwaardig is aan dit beleid, en zien toe op de naleving ervan.

7. Beveiliging

Je houdt je software, toepassingen en systemen up-to-date, gebruikt sterke en unieke wachtwoorden, en neemt redelijke maatregelen om misbruik van je account te voorkomen. Stel je een kwetsbaarheid of misbruik vast, meld het ons dan zo snel mogelijk.

8. Monitoring en handhaving

Voor de veiligheid, de goede werking en de bescherming van onze klanten mogen wij het gebruik van onze diensten in redelijke mate monitoren en vermoedelijke overtredingen onderzoeken. Bij een (vermoedelijke) overtreding van dit beleid kunnen wij, afhankelijk van de ernst, één of meer van de volgende maatregelen nemen:

een waarschuwing of een verzoek tot rechtzetting;
het verwijderen of blokkeren van inhoud;
het beperken (throttlen) van de dienst;
het opschorten of beëindigen van de dienst, zonder recht op terugbetaling;
het inlichten van de bevoegde autoriteiten wanneer de wet dat vereist.

Bij ernstige of illegale activiteiten, of bij een acute bedreiging voor onze infrastructuur of andere klanten, kunnen wij de dienst onmiddellijk en zonder voorafgaande verwittiging opschorten.

9. Misbruik melden

Stel je misbruik van onze diensten of van een gehoste website vast, meld het ons dan via onze contactpagina. We behandelen elke melding vertrouwelijk en met de nodige spoed.

10. Wijzigingen

We kunnen dit beleid van tijd tot tijd aanpassen, bijvoorbeeld wanneer onze diensten of de toepasselijke regelgeving wijzigen. De meest recente versie vind je steeds op deze pagina.

This Acceptable Use Policy ("AUP") describes what is and isn't allowed when using Upstream's services. It forms an integral part of and supplements our general terms and conditions. By using our services, you agree to this policy.

1. Scope and who this applies to

This policy applies to all of our services, including web hosting, VPS and cloud servers, domain registration, email, data center and housing, and managed services. It applies to every customer and to anyone who uses our services through that customer: employees, sub-accounts, resellers' customers and visitors of hosted websites. The customer is responsible for all use that takes place under their account or service.

2. Permitted use

You use our services solely for lawful purposes, in accordance with the agreement, this policy and applicable law. You respect the rights of other users and the proper operation and security of our infrastructure.

3. Prohibited use

It is prohibited, among other things, to use our services for:

illegal content or activities, including child sexual abuse material, terrorism, or incitement to hatred, violence or discrimination;
infringing intellectual property or copyright, or distributing illegally obtained material;
spam or unsolicited bulk email, phishing, scams, fraud, fake webshops or other deceptive practices;
distributing malware, viruses, ransomware or other harmful software;
hacking, unauthorised access, port scans, exploits or denial-of-service attacks (DoS/DDoS);
running open mail relays, open proxies, botnets or command-and-control infrastructure;
cryptomining without our explicit permission;
excessive use of shared resources that harms the service to other customers;
circumventing security measures, usage limits or access controls.

4. High-risk or restricted activities

Certain activities are only allowed if you comply with the rules, and sometimes after prior consultation with us:

Bulk mailing, newsletters and marketing email: sending bulk or marketing email through our services is only permitted with our prior written approval. Even with that approval, a valid opt-in and anti-spam legislation always apply. Without our explicit permission, bulk mailing is not allowed;
Adult content: only insofar as legally permitted and properly restricted;
Heavy or atypical resource usage: in consultation, so that stability for other customers is safeguarded.

5. Compliance with law and sanctions

You use our services in accordance with all applicable Belgian and European law, including privacy law (GDPR), consumer and e-commerce law, telecom rules and intellectual property law. Our services may not be used in breach of international sanctions and export regulations, nor by or for the benefit of persons or entities on an applicable sanctions list.

6. Responsibility for third parties and sub-users

You are fully responsible for the use of our services by your employees, sub-accounts, end customers and visitors of your websites or applications. Resellers and customers who offer our services to third parties impose on their own customers a policy that is at least equivalent to this policy, and monitor compliance with it.

7. Security

You keep your software, applications and systems up to date, use strong and unique passwords, and take reasonable measures to prevent misuse of your account. If you discover a vulnerability or abuse, please report it to us as soon as possible.

8. Monitoring and enforcement

For security, proper operation and the protection of our customers, we may monitor the use of our services to a reasonable extent and investigate suspected violations. In the event of a (suspected) breach of this policy, we may, depending on the severity, take one or more of the following measures:

a warning or a request to remedy;
removing or blocking content;
throttling the service;
suspending or terminating the service, without any right to a refund;
informing the competent authorities where required by law.

In the event of serious or illegal activity, or an acute threat to our infrastructure or other customers, we may suspend the service immediately and without prior notice.

9. Reporting abuse

If you notice abuse of our services or of a hosted website, please report it to us via our contact page. We treat every report confidentially and with due diligence.

10. Changes

We may amend this policy from time to time, for example when our services or the applicable regulations change. The most recent version is always available on this page.
